6. Transport planning, permits and escorts

Some heavy transport, oversize, overmass or over-dimensional loads may require additional planning, route assessment, permits, pilots, escorts or other approvals.

Where required, these may need to be arranged before transport can proceed.

Timeframes, costs and availability may vary depending on the load, route, location and regulatory requirements.

Unless otherwise agreed in writing, permit, escort, pilot, route assessment, waiting time, site delays and other job-specific costs may be charged in addition to transport fees.

7. Customer responsibilities

Customers must ensure that:

accurate job and load information is provided
pickup and delivery locations are safe and accessible
loading and unloading areas are suitable
site contacts are available where required
machinery or equipment is ready for transport
any keys, documents, access permissions or inductions are available
any site-specific safety requirements are communicated before the job
payment terms are met

If access, loading, unloading or site conditions are unsafe or unsuitable, we may delay, reschedule or cancel the job.

8. Pricing and payment

Prices may be provided by quote, day rate, hourly rate, distance, project rate or another agreed method.

Unless otherwise stated, quoted prices may be subject to change if the job details, access, route, timing, load dimensions, weight, permits, escorts, waiting time or other requirements change.

9. Cancellations, delays and waiting time

Cancellations, late changes, site delays, loading delays, unloading delays, permit delays, access issues or customer-caused waiting time may result in additional charges.

If a job is cancelled after planning, mobilisation, permits, escorts, subcontractors or other costs have been arranged, the customer may be responsible for costs already incurred.

10. Safety and compliance

We may refuse, delay or stop work if we believe there is a safety risk, legal issue, access problem, unsuitable loading or unloading condition, or any other factor that may affect safe transport.

All work is subject to applicable road rules, heavy vehicle laws, safety requirements, Chain of Responsibility obligations, site rules, permit conditions and legal operating requirements.

11. Insurance and risk

Load Heavy Transport maintains insurance relevant to its business operations.

Customers are responsible for ensuring they hold any insurance required for their own machinery, equipment, goods, site, project, property or business risks.

Unless otherwise agreed in writing, we are not responsible for loss, damage, delay, consequential loss, loss of profit, loss of opportunity, project delay, site downtime or indirect loss except to the extent required by law.

12. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights, guarantees or remedies that cannot be excluded under the Australian Consumer Law or other applicable laws.

To the extent permitted by law, our liability is limited to supplying the services again or paying the cost of having the services supplied again.
